Greenup Files Tax Returns From Jail
After years of protest, militia leader Calvin Greenup has filed state income tax returns for 1991 and 1992.
Greenup, now serving 30 days in the Ravalli County Jail on charges related to his illegal game farm near Darby, completed his returns in October, according to records on file in District Court in Helena.
The tax returns were among the sticking points in Greenup’s dispute with the state. He refused summons to appear in court to explain his failure to file, asserting he was not subject to state jurisdiction.
In one letter to the court, Greenup said he “is not a resident, person or subject over which the sovereign power of the bankrupt corporate state of Montana extends.”
The state Revenue Department has filed taxes and fines against Greenup totaling almost $9,500 for the two years he failed to file returns, court records show.
But state lawyers said they cannot release information on tax payments by Greenup because income tax information is confidential.
John Smith, Greenup’s Missoula attorney, said his client also has filed federal income tax returns for 1991 and 1992.
