Court Backs Out Of Abortion Issue

Court approval is not required for an Ada County Jail inmate to get an abortion, a judge has ruled.

On Friday, 4th District Judge Daniel Eismann refused inmate Tynia Johnson’s request to authorize her abortion. She is nearing her second trimester.

In a court order released Monday, Eismann said “the providing of medical services to jail inmates is a matter within the discretion of the Ada County sheriff.

“There is no statute which requires or provides for prior court approval for such medical services,” Eismann said in the two-page opinion filed 5 p.m. Friday - court closing time.

Sheriff Vaughn Killeen’s policy is that an abortion is only permitted with a court order. , DataTimes
