Unser Plans Appeal

Compiled From Wire Services

Three-time Indianapolis 500 winner Bobby Unser said he plans to appeal his conviction and $75 fine for riding a snowmobile in a wilderness area.

On June 12, U.S. District Judge Lewis Babcock of Denver convicted Unser of violating the federal Wilderness Act of 1964 and fined him $75. Unser had faced a maximum penalty of $5,000 fine and up to six months in jail.

As the basis for his appeal, Unser said his lawyers would argue that prosecutors never proved criminal intent when Unser and a friend became stranded in Colorado’s snowy back country for two days in December when a snowmobile broke down.

Scott Sharp, seriously injured in practice for the Indianapolis 500, has returned to driving and will race next weekend, the Conseco/A.J. Foyt team announced Monday.
