Developer Appeals Order To Remove Sign
The City of Post Falls is being sued over a sign on the corner of Seltice Way and Cedar Street.
The plaintiff, Riverside Development Co., questions whether the city has the right to force the company to remove the sign and whether the sign is an on- or off-premises sign.
Off-premises signs are illegal within city limits.
When the city told Riverside Development to remove the sign, the company appealed to the city Planning and Zoning Commission.
When the commission denied its appeal, it appealed to the city council, which also denied the appeal.
The civil lawsuit, filed on Monday, is the next step in the appeals process.
“I think we’re on pretty firm ground here,” said Gary Young, the city’s Planning and Building Director.
Even if the company does win the suit, he said, it would be unlikely to affect other signs in the city or the sign ordinance in general.
