Critics Assail Property Rights Bill
Opponents to a property rights bill in the Legislature warn it could erode communities’ power to plan growth, as well as harm the environment.
The bill sponsored by Rep. Jim Kempton, R-Albion, would create an appeals process for landowners whose property value fell as a result of government action.
“If this legislation is adopted, we’re just putting our state up to the highest bidder,” Idaho Rivers United director Wendy Wilson said Thursday.
Land speculators and developers could bankrupt cities and counties by constantly appealing governmental decisions, Wilson said.
Kempton said his bill provides fairness to property owners whose land has lost value, but who have not been subject to a legal taking of property. Speculators would not benefit from the bill, he said.
“You have to have an actual case that has caused you harm, that you can demonstrate has affected you,” he said.
