Post Falls Man Faces New Trial In Slaying
A summer trial has been set for a Post Falls man whose attempted second-degree murder conviction was overturned by the state Supreme Court.
First District Judge Gary Haman ordered Wednesday that Daniel Buckley stand trial on Aug. 3. Buckley had been serving a five- to 15-year prison sentence after a Kootenai County jury found him guilty in 1995.
Earlier this year, the high court agreed with the Idaho Court of Appeals that one of the instructions given to the jury was incorrect. A requirement that jurors find Buckley intended to kill Michael Byrnes in order to convict Buckley of the charge was missing from the instruction, the court found in overturning the conviction.
Buckley is accused of shooting Byrnes in the neck with a high-powered rifle in late 1994 at the end of a running argument. The dispute arose over $100 Byrnes had borrowed from Buckley’s girlfriend to post bail after being arrested.
