Bill Shields Farmers From Nuisance Suits

A bill that would make potential home buyers sign a waiver before moving into an agricultural area passed the House Wednesday.

“This is a win-win deal for farmers and potential buyers,” said Rep. Frances Field, R-Grandview, the bill’s sponsor.

The waiver would point out to the potential buyers the smell, sounds and general nuisances that go along with living in an agricultural area.

The legislation would serve to protect a farmer’s right to farm and would end lawsuits from unhappy farm neighbors.

Rep. Wayne Meyer, R-Rathdrum, excused himself from voting because he is a grass grower and he worried voters might assume this was his bill and that it would affect grass burning.

Field said the bill would not affect grass burning or dairies, and would only affect areas that already have been designated as agricultural.
